Privacy Notice

In compliance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and the Privacy Notice Guidelines, the following Comprehensive Privacy Notice is made available to you.

1. Identity and address of the Controller

Miguel Angel Cantu Garza, an individual with entrepreneurial activity under the Simplified Trust Regime (RESICO), operating under the trade name “De Marketing”(hereinafter, the “Controller” or “De Marketing”), is the controller responsible for the processing of your personal data.

2. Personal data we collect

For the purposes described in this notice, we may collect the following personal data:

  • Identification data: full name
  • Contact data: email address, phone number
  • Employment data: company, role, industry
  • Commercial data: business goals, estimated budget and marketing needs
  • Browsing and device data: IP address, browser type, operating system, pages visited, referral source, and cookie or advertising pixel identifiers

We do not collect sensitive personal data (racial origin, health status, genetic information, religious beliefs, political opinions, sexual preferences, or similar data deemed sensitive under the LFPDPPP).

3. Purposes of processing

3.1 Primary purposes

These purposes give rise to and are necessary for the legal and commercial relationship between you and De Marketing. They do not require additional consent:

  • Respond to information requests and contact submitted via forms or email
  • Schedule and follow up on appointments, meetings, and calls
  • Quote, contract, and deliver digital marketing consulting services
  • Issue invoices and comply with tax obligations
  • Maintain records and communication during service delivery
  • Address claims, clarifications, and contractual obligations

3.2 Secondary purposes

These purposes are not necessary for the main legal relationship but allow us to provide a better service:

  • Sending commercial communications, newsletters, and educational marketing content
  • Running remarketing and personalized advertising campaigns on third-party platforms
  • Statistical analysis, usage metrics, and website improvement
  • Invitations to events, webinars, and product launches

If you do not want your data to be processed for secondary purposes, you may state your refusal by sending an email to miguel@demarketing.mx with the subject “Refusal of Secondary Purposes”. Your refusal will not be grounds for denying you the requested services.

4. Transfers of personal data

Your personal data may be transferred to and processed by third parties, within and outside of Mexico, in the following cases:

International transfers are made under appropriate contractual clauses and pursuant to Articles 36 and 37 of the LFPDPPP. These third parties are bound, by contract or applicable law, to maintain the confidentiality of your personal data.

We do not sell your personal data to third parties under any circumstances.

5. ARCO Rights

As the data subject, you have the right to:

  • Access your personal data and learn details of its processing
  • Rectify your data when inaccurate or incomplete
  • Cancel your data when you believe it is no longer required for any of the stated purposes
  • Object to the processing of your data for specific purposes

Procedure to exercise your ARCO rights

Send a request to miguel@demarketing.mx with the subject “ARCO Rights Request” including:

  1. Full name and means to receive a response (email)
  2. Document proving your identity (copy of valid official ID) or, if applicable, legal representation of the data subject
  3. Clear and precise description of the personal data on which you seek to exercise any of the rights
  4. Any other element or document that helps locate the personal data

We will respond to your request within a maximum of 20 business days from the date of receipt. The response and, where applicable, the requested data will be delivered free of charge, except for justified shipping or certified copy reproduction costs.

6. Revocation of consent

You may revoke the consent you have granted for the processing of your personal data at any time, following the same procedure described for ARCO rights. The revocation will not have retroactive effects and may, in some cases, prevent us from continuing to provide the contracted services.

7. Limitation of use or disclosure

To limit the use or disclosure of your personal data, you can:

  • Request your inclusion in our internal exclusion list by emailing miguel@demarketing.mx
  • Register with the Public Registry of Consumers (REPEP) of PROFECO to limit the use of your information for marketing purposes
  • Configure cookie preferences in your browser to block or delete unwanted cookies

8. Cookies, web beacons, and similar technologies

Our website uses cookies and similar technologies to enhance the user experience, analyze traffic, and display relevant advertising. The cookies we use are classified as:

  • Necessary cookies: essential for the operation of the site (no consent required)
  • Analytics cookies: Google Analytics 4, to understand how the site is used
  • Advertising cookies: Google Ads, Meta Pixel, for remarketing and campaign measurement
  • Tag management cookies: Google Tag Manager

You may accept, reject, or configure optional cookies from the banner that appears upon entering the site, or from your browser settings.

9. Modifications to the Privacy Notice

We reserve the right to update this Privacy Notice at any time to reflect changes in our information practices, legal requirements, or new site features. Modifications will be published at the same URL (https://demarketing.mx/en/aviso-de-privacidad) and the date of the last update will be indicated at the top of the document. We recommend reviewing this notice periodically.

10. Regulatory authority

If you believe your right to personal data protection has been violated, you may contact the National Institute of Transparency, Access to Information and Personal Data Protection (INAI):

Acceptance of the Privacy Notice. By providing your personal data through our forms, email, or any other means, you express your agreement with this Privacy Notice and grant your consent to the processing of your data under the terms described herein.
